A Conservator is typically appointed by the court in order to protect the assets of a vulnerable person. A vulnerable person typically is an adult with some type of incapacity, or a minor child.
Conservatorships can be flexible, and the court can grant broad or limited powers. For example, a court can allow a conservator to buy, sell or manage lease real estate on behalf of the protected person. The individual that is nominated to be a Conservator will likely be subject to a background check.
In Minnesota, there is a two part test to determine whether a person needs a Conservator: 1) an individual who is unable to manage property and business affairs because of an impairment in the ability to receive and evaluate information or make decisions, even with the use of appropriate technological assistance, or because the individual is missing, detained, or unable to return to the United States; and 2) who has property that will be wasted or dissipated unless management is proved or money is needed for the support, care, education, health, and welfare of the individual or of individuals who are entitled to the individual’s support and that protection is necessary or desirable to obtain or provide money.
