Revocable Trust

Most people are familiar with what is known as a Revocable Trust. These are typically used in planning for one’s death, or for the onset of disability. One of the attractive things about a Trust is privacy.

In order to be effective, a Revocable Trust must be funded. What does that mean? Titling the appropriate assets so that the Trust owns them and identifying the Trust as the beneficiary of the applicable assets. Funding a Trust is an area where many people run into problems. They assume that after the Trust has been drafted and signed that there is no more work to be done, or that the attorney is handling everything. Another major concern is who to name as successor Trustee.

Do you want a trusted family member? Will that person be too busy to handle the task. Should a corporate trustee be named instead, or act as a co-trustee?
